1.1.2 Multi-Vertical Coverage: MeetUrNeed operates an integrated travel and enterprise technology ecosystem. These Terms govern all consumer services (B2C) including vehicle rentals, adventure activities, and tour bookings, as well as enterprise software solutions (B2B) including Cloud Point of Sale (POS), School Management Systems (SMS), Smart School Canteens, and Vendor Marketplace infrastructure.
1.1.3 Scalability & Modifications: MeetUrNeed reserves the absolute right to revise, amend, or restructure these Terms at any time to accommodate platform scaling, statutory revisions, or new technical modules. Continued platform interaction post-publication constitutes full acceptance of modified Terms.
1.2 Account Registration, Security & Verification
1.2.1 Account Eligibility: Consumer account holders must be at least 18 years of age with full legal capacity to contract under the Indian Contract Act, 1872. For institutional, student, or minor accounts (e.g., School Canteen wallets), registration and authorization must be executed by an authorized parent, legal guardian, or accredited school administrator.
1.2.2 Information Accuracy: Users warrant that all submitted details—including legal names, mobile phone numbers, email addresses, tax identifiers, and official identification—are truthful, current, and complete. Account registration using pseudonyms or stolen credentials will lead to immediate account suspension and referral to legal authorities.
1.2.3 Credential Custody: Users and institutional administrators are solely responsible for securing their account passwords, two-factor authentication (2FA) tokens, API keys, and terminal sessions. MeetUrNeed is not liable for unauthorized transactions arising from compromised operator credentials.
2.1.1 Mandatory Driving Licence Validation: The Hirer must present an original, unexpired physical Driving Licence recognized under the Motor Vehicles Act, 1988, matching the operational class of the reserved vehicle. Digital reproductions, scans, and Learner's Licences are strictly prohibited.
2.1.2 Government Identity Collateral: Handover requires the temporary deposit of one original, authentic government-issued identity document (original Voter ID, Passport, or Aadhaar Card) as legal bailment collateral, retained securely in hub vaults until return clearance. Corporate IDs or laminated duplicates are invalid.
2.1.3 Security Deposit Mandate: MeetUrNeed reserves the right to charge an upfront refundable security deposit prior to releasing vehicle keys.
2.2.1 Operating Window: Station counters operate daily between 09:00 AM and 09:00 PM IST. Handover and check-in procedures must be finalized within this operational window.
2.2.2 Hard Nightly Cut-off Protocol: All vehicles scheduled for same-day return must be handed over by 09:00 PM IST. Returns attempted after 09:00 PM roll over to 09:00 AM the following morning and incur overnight holding fees and an extra full-day rental charge.
2.2.3 Authorized Operational Radius & GPS Geofencing: Vehicles may only be driven within pre-authorized regional zones. Taking rental vehicles across unauthorized inter-state borders without written endorsement triggers GPS breach alerts, ignition immobilization, deposit forfeiture, and legal reporting.
2.3.1 IoT Speed Monitoring: Non-geared scooters carry a speed cap of 75 km/h; geared motorcycles carry a speed cap of 90 km/h. The 1st and 2nd alerts trigger warnings; a 3rd alert incurs a penalty of ₹200; each subsequent violation incurs a ₹500 fine.
2.3.2 Protective Equipment: Wearing an ISI-certified safety helmet is legally mandatory for both the operator and pillion rider.
2.3.3 Zero Tolerance for Impairment: Operating vehicles under the influence of alcohol or narcotics is prohibited, automatically voiding insurance and transferring 100% of civil and criminal liability to the operator.
2.4.1 Pre-Trip Inspection: Hirers must complete a joint walkthrough with hub personnel to record pre-existing blemishes and fuel levels in the check-in log.
2.4.2 Consequential Mechanical Damages: Continued operation following impacts or warning lamps resulting in engine seizure or transmission breakdown is classified as operator negligence, recoverable in full from the hirer.
2.4.3 Quality Control (QC) Return Inspection: Collateral and deposits are released solely upon successful completion of the post-rental QC inspection.
3.1 Voluntary Assumption of Risk & Guide Authority
3.1.1 Mountain Hazards Acknowledgement: Participants acknowledge that outdoor activities—including tandem paragliding, high-altitude trekking, and water sports—involve natural environmental risks. Participation is voluntary.
3.1.2 Pilot & Lead Guide Authority: Certified tandem pilots and trek leaders hold absolute operational authority to abort takeoffs, change flight trajectories, or alter routes based on meteorological assessments.
3.2 Participant Health, Fitness & Declarations
3.2.1 Mandatory Health Declarations: Participants must disclose cardiovascular issues, epilepsy, hypertension, spinal injuries, or pregnancy.
3.2.2 Safety Exclusions: Operators reserve the right to deny participation to individuals deemed physically unfit or intoxicated without refund.
3.2.3 Weight Thresholds: Tandem paragliding enforces operational weight limits (typically 35 kg to 90 kg), subject to real-time wind conditions.
4. Enterprise Point of Sale (POS) & Restaurant Systems
4.1 Cloud Software Licensing & Provisioning
4.1.1 SaaS License Grant: MeetUrNeed grants registered merchants a non-exclusive, non-transferable, revocable cloud subscription to access the POS interface, billing engines, inventory controllers, and kitchen displays.
4.1.2 Connectivity Requirements: Merchants must maintain active on-premise internet connectivity, local networks, and compatible hardware peripherals.
4.2.1 Real-Time Kitchen Polling: The POS integrates automated server polling, KDS workflows, and audio/visual order alerts. Merchants must maintain active browser permissions and functional audio hardware.
4.2.2 Offline Transaction Queuing: Transactions queued during temporary connectivity drops must be synchronized to the cloud before closing shifts.
4.3 Tax Configuration & Fiscal Compliance
4.3.1 Merchant Fiscal Responsibility: Merchants hold sole legal responsibility for configuring accurate Goods and Services Tax (GST) slabs, cess rates, and menu pricing. MeetUrNeed disclaims liability for tax miscalculations resulting from merchant setup.
5. Educational Software: School Management System (SMS)
5.1 Institutional Licensing & Role Separation
5.1.1 Enterprise SaaS Provisioning: MeetUrNeed provides an educational cloud ERP covering student databases, attendance logs, gradebooks, timetable scheduling, and parent communication channels.
5.1.2 Role-Based Access Controls (RBAC): Institutions are responsible for configuring staff permissions (Super-Admin, Teacher, Accountant, Parent/Student).
5.2 Student Data Confidentiality & Processor Obligations
5.2.1 Data Processor Designation: The educational institution acts as the Data Fiduciary, while MeetUrNeed acts strictly as the Data Processor.
5.2.2 Non-Monetization Pledge: Student records, attendance histories, and guardian contacts will never be sold, leased, or monetized for commercial advertising.
5.3 Integrated Fee Gateway Collections
5.3.1 Gateway Routing: Tuition and facility fee collections routed via integrated gateways settle directly into verified institutional accounts. MeetUrNeed does not retain institutional capital.
6.1.1 Closed-Loop Architecture: The canteen system operates as a closed-loop digital wallet utilizing RFID/NFC smart cards or encrypted student QR codes.
6.1.2 Cashless Checkout: Canteen terminals deduct approved cafeteria purchases against the student's prepaid balance upon verifying dietary rules.
6.2.1 Spending Controls: Guardians can set daily or weekly transaction ceilings and review meal histories via their portal.
6.2.2 Allergen & Nutritional Guardrails: Parents may flag restricted food categories (such as nuts or soda); the POS terminal will block flagged items during checkout.
6.3 Food Safety Standards & FSSAI Compliance
6.3.1 Vendor Liability: MeetUrNeed provides transaction software only. The cafeteria operator or caterer holds exclusive legal liability for kitchen hygiene, food freshness, and active FSSAI licensing.
7. B2B Merchant, Fleet & Vendor Marketplace
7.1 Vendor Onboarding & Listing Warranties
7.1.1 Commercial Verification: Vendors listing fleets, activities, or restaurant menus must submit verified business PAN, GSTIN credentials, and operating permits.
7.1.2 Fulfillment Warranty: Vendors must honor confirmed bookings. Unexcused merchant cancellations or fleet unavailability will trigger default penalties.
7.2 Commission Structure & Settlement Cycles
7.2.1 Platform Retainage: MeetUrNeed retains agreed commissions or recurring SaaS licensing fees as specified in individual commercial contracts.
7.2.2 Payout Schedules: Net merchant disbursements are processed on a T+2 or T+3 business day settlement cycle.
8.1.1 IP Rights: All software code, UI interfaces, branding, and databases are the exclusive proprietary property of MeetUrNeed.
8.1.2 Indemnification: Users and merchants agree to defend and hold harmless MeetUrNeed against losses, penalties, or damages resulting from vehicle misuse, road traffic offenses, or merchant compliance breaches.
8.2 Limitation of Liability
8.2.1 Monetary Cap: Cumulative liability for verified claims is strictly capped at the booking amount paid for consumer reservations, or one month of SaaS fees for enterprise clients.
8.3 Governing Law & Jurisdiction
8.3.1 Exclusive Venue: These Terms are governed by the laws of India. Any unresolved dispute is subject to the exclusive jurisdiction of the competent courts in Nainital, Uttarakhand, India.
